The Urban Mill Terms and Conditions of Business

Interpretation in these Conditions:

References to ‘you’, and ‘your’ shall be deemed to be references to persons placing an order via the www.theurbanmill.co.uk website, as well as for telephone or postal orders. By placing an order, you agree to be bound by these terms and conditions. If you do not agree to these terms & conditions, you must not order through our website, emails, or phone. 'GOODS' means the goods (including any instalment of the goods or any parts for them) which the seller is to supply in accordance with these conditions 'SELLER' or 'WE' or 'US' or 'OUR' means DISPLAYSENSELTD T/A THE URBAN MILL (Company Registration No. 1389049) of Rye Street, Bishop's Stortford, Hertfordshire, CM23 2HG, UK 'CONDITIONS' means the standard terms and conditions of sale set out in this document and (unless the context otherwise requires) Before you place an order, if you have any questions relating to these Terms and Conditions, please contact our Customer Service team via help@theurbanmill.co.uk

Updating of the Range

Our range of products is continually being revised and updated. We reserve the right to change specifications without prior notice.

Specifications

All descriptions, illustrations and sizes given in this website or catalogue are for illustration purposes only and no particulars such as colour of the product therein shall be binding on the company.

Price and Discounts

All prices are quoted inclusive of VAT at the applicable current rate chargeable in the UK at the time of ordering. Please refer to ordering information for details. The Displaysense Ltd T/A The Urban Mill reserves the right to alter any prices/discounts at any time without prior notice.

Despite our best efforts of checking our pricing, there is the possibility that pricing may be wrong. Before accepting your order, we will check pricing. If at the time of ordering the price of the item is higher than the price stated, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been acknowledged by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any goods provided to you.

Delivery & Risk Delivery

The goods must be delivered to the delivery address agreed with The Urban Mill. Under no circumstances should the carrier be instructed by the buyer to deliver to another address or to leave the goods elsewhere. If the buyer or a representative of the buyer is not available to check and take delivery of the goods at the delivery address, this may result in the carrier needing to return on another date and a delivery surcharge to the buyer may apply. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract.

Lead-times are given in good faith and The Urban Mill will not be responsible for any kind of delay in transit. We are not responsible for delays outside of our control this could include examples of lock downs, industrial action or means of private or public transport. If we are aware of a delay by an event outside of our control, we will make contact with you our customer as soon as reasonably possible to ensure minimal impact.

In the unfortunate event that an item is pending delivery and is too late, should you wish to end the contract and cancel the goods due to late delivery you need to inform us in writing of this. Please see ‘Cancellation’ section. If the products have been dispatched to you or you have received them, you must return them to us, you must either return them in person or return them via a courier of your choice. Prior notice should be given to The Urban Mill - please see the ‘Returns’ section for details.

If your goods use the heavy goods service option, our delivery team will contact, you as soon as they have collected the product from us to inform you of the delivery slot available. Deliveries will be made to the ground floor and to a hallway/entrance only, we do not offer any other services. Deliveries can be made between 7am-9pm – businesses will have goods delivered within business hours. Please inform our heavy goods service of any access issues both outside and inside your home that may hinder delivery, for example, small narrow roads, small doorways and corridors. Failure to do so may encourage a failed delivery, should you wish to cancel the order a deduction will be made for fees incurred for terminating the delivery. The Urban Mill will not be held accountable for any failed delivery which has not been a direct result of fault from our end and the cancellation fee will be chargeable to you.

Large, heavy, bulky items are marked as ‘1-man’ delivery are delivered kerbside by one driver, who is not authorised to carry goods up or down steps or through a property. Due to the weight and size of these items, you will need able people to assist the driver with unloading the item. . Failure to do so may encourage a failed delivery, should you wish to cancel the order a deduction will be made for fees incurred for terminating the delivery. The Urban Mill will not be held accountable for any failed delivery which has not been a direct result of fault from our end and the cancellation fee will be chargeable to you.

Damaged, Faulty, or Incorrect Goods

Prior to dispatch great care is taken to inspect and package all goods. Upon delivery the carriers Proof of Delivery should be signed as ‘Damaged' if you believe that the goods may be damaged. All goods must be examined as immediately as possible for damage or any items missing. Damage or shortages must be reported to The Urban Mill within 14 days upon receipt of delivery - please email help@theurbanmill.co.uk and include a picture of the damage, a picture of the consignment label on the box and your order number/contact details. If the goods are found to be damaged, please ensure that you keep all packaging and replace it back in the box with the damaged item. Failure to comply with any of the above will be deemed that the goods are acceptable, and the buyer unconditionally waives any right to reject the aforementioned goods.

Our liability in respect of loss or damage to goods shall not exceed the invoice value of the goods and our liability shall in no event extend to consequential or indirect loss or damage, loss to third parties or loss of business. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, loss of business opportunity, or any indirect/consequential loss or damage.

If your product develops a fault within 30 days of purchase, we’ll exchange or refund it. If your item develops a fault within the first six months of use, we will consider repairing or replacing the item in accordance with the terms of the Consumer Rights Act 2015. Please contact help@theurbanmill.co.uk with your order details. If the item cannot be repaired a replacement or refund will be offered.

Payment

We accept the following payment methods, Debit card, Credit card, Apple Pay, Amazon Pay & PayPal Payments. We do not accept American Express.

It may display on your statement that payment has been taken by Displaysense Ltd trading as The Urban Mill.

Please note that you will be charged straight away for the whole value of the order. This is also the case for items which are pre-ordered which you will not receive straight away or with the rest of the in-stock items. To secure stock availability full payment is required unless otherwise agreed by both parties.

Cancellation

You can cancel your order, but you must contact our Customer Services Department immediately to establish the status of your order, if your order is within the Warehouse Picking team, we are unable to change or cancel your order. Visit the Contact us section for contact details. If we can stop the order from being dispatched, we'll refund the full amount of the order. If your order has been dispatched, then follow our ‘Returns’ procedure below.

If you wish to cancel your whole order and return it to us, under the Distance Selling Regulations, you must let us know within 14 working days of receiving your parcel. Please contact our Customer Service team in writing via email at help@theurbanmill.co.uk If you decide to cancel, you should return the goods to us at your cost within 14 days of such cancellation and we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply. This includes the cost of delivery (except for the supplementary costs arising if you choose a type of delivery other than our standard and least expensive method of delivery).

The Urban Mill reserves the right to cancel your order if:

  • We do not supply to your address.
  • There has been an error to pricing or the description of goods and you have reasonably identified and processed the order anyway.
  • Payment has been made by illegal means including fraudulently.
  • The merchant provider subsequently cancels your payment.
  • The items are no longer available from supply chain.

Returns

Please email help@theurbanmill.co.uk to submit a Return Request. No goods may be returned to The Urban Mill without our prior consent. Goods are returned at the buyer's own cost and risk. Goods must be returned within the 28-day money back guarantee period, from time of delivery for the return to be valid. Please repack your item with care using all the original packaging or a suitable alternative as the goods are your responsibility until they reach our warehouse. Please ensure you package your return to prevent any damage to the items or boxes.

If the item is damaged on its way back to us due to poor packaging, we will not be able to issue your full refund and will be making discretionary decision, to only partially refund, provide you with a credit note, or return the item back to you.

Please allow up to 10 working days for us to receive your return and communicate receipt of the goods

ITEMS THAT CANNOT BE RETURNED

  • We cannot accept returns of washed and/or used textile (beddings, cushions, towels, etc...), door mats, candles
  • Products with non-replaceable LED bulbs after use of the bulb beyond its recommended lifespan (bulb lifespan hours as stated in the “Size & Info” tab on appropriate product page).
  • Customs Made items cannot be returned nor refunded.

Copyright of any product manufactured by us, or any design, illustration or drawing produced by us remains the sole property of Displaysense Ltd trading as The Urban Mill unless expressly agreed in writing by Displaysense Ltd.

Customer Image Usage

We really enjoy our community sharing how they’ve styled our products in their home. Share your pics using #theurbanmill and/or @theurbanmill for a chance to be featured on our site and social platforms.

Upload your photo on Instagram, Facebook or Twitter and make sure to tag us @theurbanmill. If we’d like to repost your photo, we’ll ask for your permission to use your images on our site, social accounts or in other marketing activities. Please reply with #YESTheurbanmill to give your permission, agree to these terms & conditions, and to our privacy policy. If you agree, we’ll link to your social media account name when we post the image on our social media accounts. By replying #YESTheurbanmill you guarantee you own all rights in the photo uploaded and you grant the right to The Urban Mill to use the image without a license fee.

Reservation of title

Risk in the Goods shall pass to you when the Goods are delivered. The property of the Goods shall remain with us until you pay all sums due whether in respect of this contract or otherwise. You shall hold the Goods as our fiduciary agent and bailee until title passes. Until title passes the Goods shall be stored separately from any other Goods and you shall not interfere with any identification mark, labels batch numbers or serial numbers on the Goods. Until title passes we agree that you may use or agree to sell the goods as principle and not as our agents in the ordinary course of your business subject to the express condition that at our direction the entire proceeds of any sale or insurance proceeds received in respect of the Goods are held in trust for us and not mixed with any other monies or paid into an overdrawn bank account and shall at all times be identifiable as our money. We shall be entitled to recover the price of the Goods including VAT even though the property in any of the Goods remains with us. We shall be entitled at any time to recover any or all of the Goods in your possession to which we have title and for that purpose we our servants or agents may with such transport as is necessary enter upon any premises occupied by you or to which you have access and where the Goods may be or are believed to be situated.

Instagram Monthly Giveaway

One winner will be selected from all valid entries. The winners will be chosen at random using a random number generator. We will announce the winners on The Urban Mill Instagram page within one week after the competition has closed. The selected winner(s) will be contacted via an Instagram direct message. All reasonable efforts will be made to contact the winners but if a prize is declined or unclaimed by a winner, or if a winner cannot be contacted or fails to respond, for whatever reason, within 72 hours of being contacted then a replacement winner will be randomly selected, using a random number generator, and will be notified on the same terms. The original winner and their entry will then be forfeited.

General

This contract shall be governed and interpreted exclusively accordingly to the Law of England. The Country of Merchant Domicile is the UK.

Variation
